Interim Provisions on the Administration of Internet Sites Engaged in the Business of Publishing News

(issued by the State Council Information Office and the Ministry of Information Industry)

Article XNUMX These Provisions are formulated in order to promote the development of my country's Internet news dissemination cause, regulate the business of publishing news on Internet sites, and maintain the authenticity, accuracy, and legality of Internet news.

Article XNUMX These Provisions shall apply to Internet sites engaged in the business of publishing news within the territory of the People's Republic of China.

The term "publishing news" as mentioned in these Provisions refers to publishing and reprinting news through the Internet.

Article XNUMX Internet sites engaging in the business of publishing news must abide by the Constitution, laws and regulations.

The state protects the legitimate rights and interests of Internet sites engaged in the business of publishing news.

Article XNUMX The Information Office of the State Council shall be responsible for the management of the news publication business on Internet sites across the country.

The information offices of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, in accordance with these regulations, be responsible for the management of the news publishing business of Internet sites within their respective administrative regions.

Article XNUMX Internet sites (hereinafter referred to as news websites) legally established by central news units, news units of various departments of the central state organs, and news units directly under the jurisdiction of provinces, autonomous regions, municipalities, and cities where the people's governments of provinces and autonomous regions are located (hereinafter referred to as news websites) may, upon approval, publish news business.Other news units do not independently establish news websites, but upon approval may establish news pages on news websites established by central news units or news units directly under the central government or provinces, autonomous regions, and municipalities directly under the Central Government to engage in news publishing business.

Article XNUMX When a news unit establishes a news website (page) to engage in the business of publishing news, it shall report to the State Council Information Office or the Information Office of the people's government of a province, autonomous region or municipality directly under the Central Government for examination and approval in accordance with the following provisions:

(XNUMX) Central news units establish news websites to engage in news publishing business, and report to the State Council Information Office for examination and approval.

(XNUMX) The news units of various departments of the central state organs establish news websites to engage in the business of publishing news, which shall be reviewed and approved by the competent departments and reported to the State Council Information Office for approval.

(XNUMX) News units directly under the jurisdiction of provinces, Yintai districts, municipalities directly under the Central Government, and the municipalities where the people's governments of provinces and autonomous regions are located to establish news websites to engage in news publishing business shall be examined and approved by the information offices of the people's governments of the provinces, autonomous regions, and municipalities directly under the Central Government where they are located, and reported to the State Council Information Office for approval.

(XNUMX) News units below the province, autonomous region, or municipality directly under the Central Government establish news pages on news websites of central news units or news units directly under the province, autonomous regions, or municipalities directly under the Central Government to engage in news publication, and report to the information office of the people's government of the province, autonomous region, or municipality where they are located for examination and approval, and Report to the State Council Information Office for the record.

Article XNUMX Comprehensive Internet sites established by non-news units in accordance with the law (hereinafter referred to as “comprehensive non-news unit websites”) that meet the conditions listed in Article XNUMX of these Provisions may, upon approval, publish news from central news units and central state organs The business of news released by units and directly affiliated news units of provinces, autonomous regions, and municipalities directly under the Central Government, but may not publish news collected and written by themselves or news from other sources.Other Internet sites that are not legally established by news units shall not engage in the business of publishing news.

Article XNUMX The website of a comprehensive non-news unit engaging in the business of publishing news in accordance with Article XNUMX of these regulations shall be examined and approved by the information office of the people's government of the province, autonomous region, or municipality directly under the Central Government where the sponsor is located, and reported to the State Council Information Office for approval.

Article XNUMX The websites of comprehensive non-news entities engaging in the business of publishing news shall meet the following conditions:

(XNUMX) It has the purpose, rules and regulations for engaging in the business of publishing news in compliance with laws and regulations;

(XNUMX) Having the necessary news editing organization, funds, equipment and premises;

(XNUMX) There are full-time news editors in charge with very relevant news work experience and professional and technical job qualifications for journalism at or above the intermediate level, and a corresponding number of full-time news editors with professional and technical job qualifications for journalism at or above the intermediate level;

(XNUMX) There are news information sources that meet the provisions of Article XNUMX of these regulations.

Article XNUMX When an Internet site applies for engaging in the business of publishing news, it shall fill in and submit the "Application Form for the Business of Publishing News on Internet Sites" uniformly prepared and distributed by the State Council Information Office.

Article XNUMX A comprehensive non-news unit website engaged in the business of publishing news released by central news units, news units of various departments of the central state organs, and news units directly under the province, autonomous region, or municipality directly under the Central Government shall sign an agreement with the above-mentioned relevant news unit, and the agreement shall be signed. A copy should be reported to the information office of the people's government of the province, autonomous region or municipality directly under the Central Government where the sponsor is located for the record.

Article XNUMX When a comprehensive non-news unit website publishes news released by central news units, news units of various departments of the central state organs, and news units directly under the province, autonomous region, or municipality directly under the Central Government, the source and date of the news shall be indicated.

Article XNUMX News published on Internet sites shall not contain the following contents:

(XNUMX) Violating the basic principles established by the Constitution;

(XNUMX) Endangering national security, divulging state secrets, inciting subversion of state power, and undermining national unity;

(XNUMX) Damage the honor and interests of the state;

(XNUMX) Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;

(XNUMX) Undermining the state's religious policy, promoting cults, and promoting feudal superstition;

(XNUMX) Spreading rumors, fabricating and spreading fake news, disrupting social order and undermining social stability;

(XNUMX) Spreading obscenity, pornography, gambling, violence, terror or instigating crimes;

(XNUMX) Insulting or slandering others, infringing upon the legitimate rights and interests of others;

(XNUMX) Other content prohibited by laws and regulations.

Article XNUMX Internet websites linking to overseas news websites and posting news published by overseas news media and internet websites must be separately reported to the State Council Information Office for approval.

Article XNUMX Anyone who violates these regulations and falls under any of the following circumstances shall be given a warning by the Information Office of the State Council or the Information Office of the people's government of a province, autonomous region or municipality directly under the Central Government, and ordered to make corrections within a time limit; those who have obtained the qualification to engage in the business of publishing news, if the circumstances are serious, shall be revoked Qualifications for engaging in the business of publishing news:

(XNUMX) Posting news without authorization;

(XNUMX) A comprehensive non-news unit website publishes news collected and written by itself or publishes news that does not meet the sources specified in Article XNUMX of these regulations, or does not indicate the source of the news;

(XNUMX) The comprehensive non-news unit website publishes the news released by it without signing an agreement with the central news unit, the news unit of each department of the central state organ, or the news unit directly under the province, autonomous region, or municipality directly under the Central Government, or the signed agreement fails to go through the filing procedures;

(XNUMX) Without approval, linking to overseas news websites and publishing news published by overseas news media and Internet sites.

Article XNUMX If news published on Internet sites contains any of the contents listed in Article XNUMX of these Provisions, and constitutes a crime, criminal responsibility shall be investigated according to law; administrative penalties are imposed.

Article XNUMX If the news posted on an Internet site contains any of the contents listed in Article XNUMX of these Regulations or has any of the circumstances listed in Article XNUMX of these Regulations, the competent department of information industry under the State Council or the telecommunications management agency of a province, autonomous region or municipality directly under the Central Government shall comply with According to relevant laws and administrative regulations, the website may be ordered to be closed.And revoke its telecommunications business license.

Article XNUMX Internet sites that have engaged in the business of publishing news before the implementation of these regulations shall go through the corresponding formalities in accordance with these regulations within XNUMX days from the date of implementation of these regulations.

Article XNUMX These regulations shall come into force on the date of promulgation.
