Second The provision of commenting services within the territory of the People's Republic of China shall abide by these regulations.
The term “post comment service” as mentioned in these regulations refers to Internet sites, applications, interactive communication platforms and other communication platforms with news and public opinion attributes and social mobilization functions, which provide users with information such as posting, replying, leaving messages, and “barrage”. Provide services for publishing text, symbols, expressions, pictures, audio and video and other information.
Article 3 The Cyberspace Administration of China is responsible for the supervision, management and law enforcement of post comment services across the country.Local Internet Information Offices are responsible for the supervision, management and law enforcement of the post and comment services in their respective administrative regions.
Internet information offices at all levels shall establish and improve a supervision and management system that combines daily inspections and regular inspections, and regulate the post comment service behavior of various dissemination platforms in accordance with the law.
Article 4 Thread comment service providers that provide new thread comment products, new applications, and new functions related to Internet news information services shall report to the national or provincial, autonomous region, or municipal Internet Information Office for security assessment.
The fifth Thread comment service providers shall strictly implement their main responsibilities and perform the following obligations in accordance with the law:
(XNUMX) In accordance with the principle of "real name in the background and voluntary in the front desk", the real identity information of registered users shall be authenticated, and the post comment service shall not be provided to users who have not authenticated their real identity information.
(XNUMX) Establish and improve the user information protection system. The collection and use of users' personal information shall follow the principles of legality, legitimacy and necessity, disclose the collection and use rules, express the purpose, method and scope of the collection and use of information, and obtain the consent of the person being collected. .
(XNUMX) If providing follow-up commenting services for news information, a system shall be established for review before publication.
(XNUMX) Those who provide the "barrage" method of commenting on posts shall provide the corresponding static version of the information content on the same platform and page at the same time.
(XNUMX) Establish and improve information security management systems such as post comment review management, real-time inspections, and emergency response, timely discover and dispose of illegal information, and report to the relevant competent authorities.
(XNUMX) Develop thread comment information security protection and management technology, innovate thread comment management methods, develop and use anti-spam information management systems, and improve the ability to deal with spam information; timely discover security defects, loopholes and other risks in thread comment services, Take remedial measures and report to the relevant authorities.
(XNUMX) Equipping a review and editing team that is commensurate with the scale of services to improve the professional quality of review and editors.
(XNUMX) Cooperate with relevant competent departments to carry out supervision and inspection work according to law, and provide necessary technical, information and data support.
Article XNUMX Thread comment service providers shall sign service agreements with registered users, clarify the service and management rules for thread comments, fulfill the obligation to inform relevant Internet laws and regulations, and carry out civilized online education in a targeted manner.
Thread comment service users should be strictly self-disciplined, promise to abide by laws and regulations, respect public order and good customs, and must not publish information that is prohibited by laws, regulations and relevant state regulations.
Article XNUMX Thread comment service providers and their practitioners shall not interfere in public opinion by selectively deleting or recommending thread comments for the sake of seeking illegitimate interests or based on wrong value orientation.
Thread comment service providers and users shall not use software, employment of commercial organizations and personnel to disseminate information, interfere with the normal order of thread comments, and mislead public opinion.
eighth Thread comment service providers shall promptly take measures such as warning, refusing to publish, deleting information, restricting functions, suspending updates or closing accounts, etc., and keep relevant records when publishing information content that violates laws and regulations and relevant national regulations.
Article XNUMX Thread comment service providers shall establish a user classification management system, conduct credit assessments on users' thread comments, determine service scope and functions according to their credit levels, blacklist users who are seriously untrustworthy, and stop blacklisting users. Users of the company provide services, and prohibit them from using the post comment service by re-registering and other means.
The national and provincial, autonomous region, and municipal Internet information offices shall establish a credit file and untrustworthy blacklist management system for commenting service providers, and regularly conduct credit evaluations for commenting service providers.
Article XNUMX Thread comment service providers shall establish and improve the public complaint and report system for illegal information, set up convenient complaint and report portals, and accept and handle public complaints and reports in a timely manner.The national and local Internet information offices shall, in accordance with their duties, supervise and inspect the implementation of the report acceptance.
Article XNUMX If the information security management responsibilities of the post comment service provider are not fully implemented, and there is a relatively large security risk or a security incident occurs, the Internet Information Office of the state and the province, autonomous region, or municipality directly under the Central Government shall make an interview in a timely manner; the post management service provider shall take measures as required. measures to rectify and eliminate hidden dangers.
Article XNUMX Internet thread commenting service providers who violate these regulations shall be dealt with by relevant departments in accordance with relevant laws and regulations.
Article XNUMX These regulations will come into effect on June 2017, 10.
